I WRITE on behalf of Assistant Commissioner Anderson Dunn, who has overall responsibility for the Metropolitan Police Service case-disposal policy, to respond to Graham Ball's article "Busted? You can still avoid a criminal record" (1 March). The assertion that anyone who is invited to accept a formal caution but refuses cannot then be prosecuted for the offence concerned, is not correct. In September, as there was some misunderstanding, we published guidance reminding people that a refusal to accept a caution does not always preclude prosecution.
